1. STANDARD RENTAL QUALIFICATION

The Hirer must meet the standard car hire rental agreement terms and conditions. Minimum age must be 23 years and maximum age must be 75 years with a valid local or International driving license. Failure to meet the standard terms and conditions of a rental will result in refusal of rental. The hirer will be bound by the laws governing the Hire of the vehicle and any contravention of local laws will result in fines by the authorities concerned to the hirer.

2. VEHICLE MAKE AND MODEL

Vehicle makes and models are correct at the time of publishing. The company reserves the right to vary the make and model of the vehicle but will make every effort to honor specific car model requests. Bookings will only be confirmed by group and not by vehicle type. All vehicles are air conditioned and fitted with a radio. Cars may be collected from any Hawk rental station and may be returned to another Hawk rental station within Peninsular Malaysia, please refer to “Inter City” charges in clause 13.

3. DISCOUNT / REBATES

No further discount or deductions will be entertained on published rates.

4. INSURANCE

Rates include coverage of RM3 million for third party damage, unlimited for third party death or bodily injury. The hirer is obliged to promptly report any accident, theft or vandalism involving the hired vehicle to a Hawk Office and a police report lodged pertaining to the accident within 24 hours. Failure to comply with the above requirement will void all liability protection for damages, and the Hirer may be charged the full cost of damages incurred on the vehicle.

• INSURANCE EXCESS on the vehicle are as given below:-The rental rate is exclusive of Collision Damage Waiver (CDW) . Take note that upon purchase of Collision Damage Waiver (CDW) the Insurance Excess is reduced to the amount as shown below:-

• SUPER COLLISION DAMAGE WAIVER (“SCDW”)
  Should the hirer want a further reduction of the INSURANCE EXCESS / NWE, the hirer can purchase “SCDW” (Super Collision Damage Waiver). By accepting this, the hirer is reducing the liability for damages to the vehicle to ZERO , subject to the payment of SCDW rates per day:-

  Note: – Zero excess is AVAILABLE -Terms & Conditions apply.
  Missing items or accessories are NOT PROTECTED by our insurance or by purchase of CDW and / or SCDW, & will be the responsibility of the Hirer, i.e. Radio / CD, Hubcaps, CD Equipment, Tools or any other accessory fitted on the vehicle.
  Accepting CDW by the Hirer will limit the Hirer’s responsibility to the above reduced NON WAIVABLE EXCESS (“NWE”). However, if the accident was a “Single Accident” defined as no third party being involved, the nature of the accident needs to be determined and the hirer will be notified accordingly on his / her liability. In the event of the Hirer being found to be under the influence of alcohol or any intoxicating substance, all damage cost incurred will be the full responsibility of the Hirer including loss of use.
  
  Theft Protection

  Theft of the vehicle is covered under Collision Damage Waiver (CDW) and Super Collision Damage Waiver [SCDW]. Therefore, in the event of theft, the hirer is firstly required to lodge a Police Report within 24 hours and the Hirer will be responsible for the excess amount as indicated for the specific model rented.
  *Theft Protection covers only theft of the whole car, the keys must be returned to the station.
  
  

• PERSONAL ACCIDENT INSURANCE (“PAI”)PERSONAL ACCIDENT INSURANCE (PAI)
  PERSONAL ACCIDENT INSURANCE (PAI) – Provides coverage of RM 150,000.00 ( 5 PASSENGERS FOR A SALON VEHICLE AND 7 PASSENGERS FOR A MPV VEHICLE ) and the rate is as follows :

  The coverage is extended for injuries sustained inside or outside the vehicle, during the agreed period of the hire, for the Hirer. The Cover is for the Hirer and a maximum of 5 (five) passengers for saloon vehicles and 7 (seven) passengers for MPV’s.

  Protection is only valid for the agreed period of Hire as indicated on the rental agreement. Any extension of rental must be authorized by Hawk, and noted on the rental agreement, failing which the “PAI” cover will not be valid.

  Windscreen
  
  The customer has the option t secure coverage against the windscreen damage by opting to purchase the windscreen cover. [Please check for details at rental stations].
  
  Group A to L – RM 15.00 per day [Tax applies]
  (Failure to accept windscreen cover will cost the Hirer on the replacement cost in the event damage)
  
  Note:
  Acceptance of WSC cover, the customer’s liability to pay the full cost of replacement to a zero liability.

5. EXCESS DAYS / EXTENSION OF RENTAL
The extension or “Excess day” will apply if the hirer wants to extend the rental period from the original booking advice. Should the Hirer wish to extend, it is important that the renting station be advised immediately and the required additional rental deposit paid, so that the insurance cover is extended to cover the additional days. Failure to do so may mean that the Hirer is driving the vehicle without any insurance coverage and is in effect unauthorized to be in possession of the vehicle. Hawk reserves the right to repossess the vehicle from the Hirer without any notice given to the Hirer.

6. REPLACEMENT VEHICLE
HAWK guarantees a replacement vehicle should the need arise, of similar engine capacity from the nearest rental station, within a period of 1 hour of any Hawk Station and within 2-3 hours if the vehicles is at a Non Hawk City or Town, depending on distance and time of the day.

7. REFUELING SERVICE
A refueling service surcharge RM15.00 will be levied for vehicles returning with less gasoline than when originally rented out. All vehicles are rented with a full tank and should be returned with a full tank. The hirer is advised to check on the type of gasoline to use for the vehicle.

8.DRIVER’S LICENCE AND AGE
The Hirer and any additional driver must be a minimum of 23 years of age and maximum of 75 years of age with a valid driving licence (an International driving permit / license is preferred) which is at least 2 years in force, recognized and valid within Malaysia. The company reserves the right to decline rental to any person who is deemed physically unfit to drive.

9. PARKING AND TRAFFIC FINES
All parking fees and traffic fines will be the responsibility of the Hirer. By signing the Rental Agreement and the traffic and / or parking fines / summons form, the Hirer agrees to accept all charges pertaining to traffic and / or parking fines / summons. [Charges invoiced or directed to a credit card for traffic fines / summons will include a RM20.00 administrative fee].

10. BABY SEAT / INFANT SEAT / CHILD SEAT / BOOSTER SEAT
Baby seats are available on request and such request must be made at the time of confirming the reservation. A surcharge of RM25.00 per day or a maximum charge of RM 150.00 per rental. (Tax applicable).

11.RESERVATIONS
All bookings to be directed to the reservations department at reservations@hawkrentacar.com.my. Last minute bookings are subject to vehicle availability and rates will apply according to the most available make or model.

Each reservation MUST contain the following information:-

• Renter’s first name / Last Name / Residential Address in full / Mobile Number / Email Address
• Driving License No / Place / Country of Issue / Expiry date
• Date and Time of pick up
• Location of pick up (if airport, please provide flight number and arrival time)
• Car category / Group
• City of return
• Date / Time of return
• Additional Remarks / Additional Driver’s Name (if any) / license details
• Sender’s Name / Date / Dept / Email Address / Hand phone Number

12. HAWK RENTAL OFFICES

13.INTER-CITY RENTALS
A hirer may return or drop off a rental vehicle to another HAWK rental station in another city within Peninsular Malaysia, and will incur a minimum charge of RM 300.00 drop off fee, RM 400 for between Johor Bharu and Penang [Vice versa].
                                                                                                         
Any drop off to Kota Bharu Airport will be RM 500.00. (Tax applicable)

Pick up and Drop off between Subang Jaya [HQ] , Kuala Lumpur International Airport Terminal 1 & Terminal 2 and Kuala Lumpur City the Intercity Fee will be FREE. If not, your confirmation will be updated to reflect this.

In towns or cities where HAWK is not represented, a re-positioning fee will be levied to reposition the vehicle back to the nearest HAWK Station (see Delivery & Collection Chart A). (Tax applicable)

14.DELIVERY AND COLLECTION CHARGES
Free Delivery and Collection is offered within 5KM radius of a Hawk location. Any vehicle delivered or collected from a location other than a HAWK Office will incur a delivery and / or collection charge, depending on the distance and time of the day. For delivery and / or collection to towns where HAWK does not have a branch as per list appended (Chart A & Chart B), the charges will be as given based on normal business hours of 0800 – 1700 (Monday – Saturday).

15. WAITING FEE ( AFTER OFFICE HOURS CHARGES)

1. No surcharge applicable for pick up / return to our rental locations during office hours.      (Please refer to Hawk Rental Network)
2. The Out Of Hours pickup / drop off fee at all our rental stations from 0600 hours to 0759 hours will incur a fee of RM 100.00 and if after office hours from 1701 to  1900 hours will incur a cost of RM 150.00. HAWK will not entertain pick up / drop off after 1900 hours. (Tax applies)
3. All pickup / drop off falling on Malaysia Public Holiday is liable for Waiting Fee charges of RM 150.00. (Tax applies)
4. At the following rental locations, we have a Key Drop Box at our counter. Customer can drop off the vehicle key during hours after office hours:-
   • Kuala Lumpur International Airport 1
   • Penang Airport [ RM 35.00 Parking Ticket Fee incurred ]
   • Kota Bharu Airport

Note: The surcharge only applies to those rental locations as not mentioned in (Point 3) above

16.CANCELLATION / NO SHOW
Cancellation received less than 48 hours before the pick-up date or NO SHOW will incur a cancellation fee of RM 100.00. (Tax applies)

17.ADDITIONAL DRIVER’S FEE
A fee of RM 10.00 per additional driver per rental day will be charged. Additional drivers must present their driving license and Identification Card during pickup date. Each added driver will also be covered for damages/theft coverage.(Tax applicable)

18. PAYMENT
Hawk accepts all major credit cards, namely as Visa and Master Card  , which will need to be presented at the time of vehicle pick-up. The holder of the card will need to be present.

The credit card presented must be of the hirer’s. If that of a third party, the third-party person must be present.

HAWK reserves the right to request for an additional amount over and above the estimated rental cost to cover miscellaneous costs that may arise from the rental.
Cash rentals and debit cards are not accepted.

Direct billing to a company will require a company to provide a PURCHASE ORDER or PURCHASE REQUISITION or a letter of undertaking to pay. Such an undertaking will need to have the approval of a senior manager, of the company.

19.VEHICLE USAGE
Hirers are not permitted to drive the vehicle into SINGAPORE , THAILAND, INDONESIA and BRUNEI.

20. ROADSIDE / EMERGENCY ASSISTANCE
In the event of a breakdown, mechanical failure of the vehicle or an accident, which requires the services of a repairer, permission must first be obtained from HAWK, before proceeding to carry out any repair, towing the vehicle or purchase or replace any parts.

21.TAX
Rental rates and all miscellaneous items in a rental is subject to a 8% Sales & Service Tax (SST), imposed with effect from 1st March 2024. All miscellaneous charges indicated herein e.g. Personal Insurance Accident / Global Positioning System (GPS), Baby Seat / Additional Driver’s / Waiting Fee / Delivery and Collection to Non Hawk Station / Inter – City / Gasoline / Parking / Road Tolls , etc., are not inclusive of SST 8% and will be charged 8% SST.
